Miley Stalker Status Update -- One Stalker Indicted, One To Go

A grand jury has ruled that a 53-year-old man accused of stalking Miley Cyrus will not be indicted on felony charges. The good news for the teen pop star is that her overzealous fan isn’t getting off so easy – he’s still in jail and is set to face misdemeanor charges in a lower court.

Mark McLeod of Appling, Ga., was arrested twice this summer for lurking around the Tybee Island, Ga., movie set where the 16-year-old singer was filming “The Last Song.”

He was arrested June 22 for disorderly conduct and obstruction of a police officer after trying to breach a security perimeter around the movie set.

McLeod told police officers it was only natural he was on the set because he was there “to be with Miley.” He explained that Cyrus sent him secret messages through her Disney Channel “Hannah Montana” TV show. They supposedly had such a strong connection that McLeod had sent her a diamond ring and Cyrus had agreed to take his hand in marriage. McLeod said country singer Billy Ray Cyrus approved of his daughter and future son-in-law’s relationship and had told him, “You’re the good man we’ve been praying for.”

Cyrus’ so-called fiancé was warned not to return to the area but he came back a month and a half later, asking the security guards on set, “Is Miley around?” McLeod was arrested Aug. 4 for criminal attempted stalking and has been jailed in Chatham County since then.

After originally being charged only with misdemeanors, prosecutors had McLeod’s case sent to Superior Court for a felony charge of obstruction of a police officer. Prosecutors claimed McLeod tried to head butt an office trying to lead him away from the movie set.

The Chatham County grand jury decided prosecutors provided insufficient evidence to charge McLeod with the felony.

A spokeswoman for District Attorney Larry Chisolm said prosecutors have decided to proceed with the misdemeanor charges of attempted stalking and disorderly conduct.

As of Oct. 28 McLeod remained jailed on a $55,200 bond.

Although the jury didn’t indict McLeod on felony charges, the same group of jurors did indict another one of Cyrus’ wannabe stalkers. E! Online reported that Sean Christian Mathis, an Army airfield soldier, was indicted on charges of felony terroristic threats and misdemeanor disorderly conduct.

Mathis was also spotted hanging out near the Georgia set of “The Last Song” in June. RadarOnline.com reported the soldier was cursing because he was told he couldn’t come on the Tybee Island pier while the movie was shooting. A Tybee Island police officer told him to walk away.

When he saw Cyrus’ body double, Stephanie Vickers, on a nearby pier, Mathis starting walking towards her and yelling, "Hey, it's Miley Cyrus, I'm going to f***ing kill you."

TMZ.com reported that the police officer arrested Mathis for making terroristic threats and disorderly conduct. The military police were then called to take Mathis back to his base.
